经济社会转型期“体育公共利益”的界定和保护

在我国经济转型期,对"体育公共利益"的科学界定与保护有利于促进我国体育事业的和谐与可持续发展。从对公共利益的分析入手,指出体育公共利益是与公民个人体育利益相对的社会大部分公众主体体育欲求的转化形式,它主要表现为以"体育公共产品""体育公共服务"和"体育公共权利"为内容的公众主体对客体的主动关系和客体对于公众主体的体育好处和意义。它具备"合法性""普遍性"及"合理性"特征。研究表明,经济转型期我国的体育公共利益不但包括普通公民的体育利益,还包括以夺取"金牌"为目标的竞技体育利益。因此,经济转型期必须对体育公共利益这两方面同时加以保护。

The scientific definition and protection of sports public interest in the period of economic and social transformation can help to promote the harmonious and sustainable development of China;s sports industry. Based on the sports public interest, this paper points out that the sports public interests are conversion of the majority of the public sports needs. It mainly shows the active relation of public subject taking the ＂sports public goods＂, ＂sports public service＂ and ＂sports public rights＂ as the content to the object and the sports benefit and significance of the object to public subject. It has the ＂legitimacy＂, ＂universality＂ and ＂reasonableness＂ features. The result shows that in the period of economic and social transformation the sports public interest does not only include the sports interest of ordinary citizens, but also the competitive sports interests aimed at winning the gold medal. Therefore, in the period of transformation we must protect the two aspects of the sports public interests.
