确立惩罚性赔偿制度适用范围的理论标准

Theoretic Standards of Establishing the Applicable Scope in Punishing Payment System

调整同一类社会关系的部门法内考虑规定惩罚性赔偿制度应符合四个条件:法律关系具有明显的和相当的社会性,追究相应的公法责任与民事责任不足以消弭其严重社会危害性,适用惩罚性赔偿制度的法律关系必须由较高层级的法律规定,必须满足相当的合理性和效率性要求。

Four terms should be considered in applying punishing payment system in branch laws to adjust the same social relations： the legal relation with obvious and substantial sociality, severe social harmfulness not eliminated even by prosecuting the correlative obligations in public law and civil liability, legal relations to accommodate punishing payment stipulated by higher strata laws and meeting justifiable and efficient requirements fairly.
