我国数字图书馆版权保护问题及对策探讨

Probe into the Issue of and Countermeasures for Copyright Protection of Digital Library in China

数字图书馆的建设不可避免地涉及著作权人的知识产权保护,在保护著作权人的知识产权方面主要涉及信息资源数字化过程中的复制权和信息传递过程中的信息网络传播权。在分析我国数字图书馆版权保护存在的问题基础上,提出可通过成立版权集体管理机构、传统版权交易、实行"法定许可使用"、扩大图书馆合理使用的范围、使用者发布要约、授权要约等6种方式来保护作者的版权权益。

ABSTRACT： The construction of digital library is inevitably related to copyright owners＇ intellectual property protection, which mainly involves the reproduction right in the course of digitalization of information resources and the communication right on information network in the course of information dissemination. Based on analyzing some problems existing in copyright protection of digital library in China, this paper points out that the copyright of authors can be protected through six methods of establishing copyright collective management organizations, carrying out traditional copyright transaction, implementing legal license use, enlarging the scope of library＇s fair use, releasing the offer by user, and authorizing the offer.
