我国现行有限卷证移送方式的基本内容

在检察机关提起公诉时依法必须移送的卷证材料中,由于起诉书、证据目录和证人名单指代明确、争议不大,最高人民法院和最高人民检察院的司法解释以及"六机关"《规定》对其作了大致相同的规定,但就"主要证据复印件或照片"而言,由于"主要证据"的内涵、外延和判断标准具有较强的主观性,最高人民法院和最高人民检察院曾经对其作了截然不同的规定,即使是在"六机关"《规定》出台之后,两者仍然存在不少分歧。

Because the indictment and lists of evidence and witnesses are unequivocal,and the Supreme People＇s Court and Procuratorate and other Chinese State organs made roughly the same explanation of them,there is no much conflict.But in terms of main evidence＇s copy or photograph,since main evidence＇s connotation and standards of judgment are subjective,the Supreme People＇s Court and Procuratorate made quite different explanations of it before the Six Organs＇ Joint Regulation was issued.Even after the Six Organs＇ Joint Regulation was issued,there is still much conflict between them.
