摘要
在法律、行政法规未对违法建筑租赁合同的效力明确规定的情形下,通过司法解释来确定违法建筑租赁合同无效,并无不妥。城镇房屋租赁合同司法解释第二条关于合同效力的认定是效力性强制性规定,但其内容仍需完善,违法建筑的外延要更加明确,合法建筑与违法建筑混合体的租赁合同效力问题还需细化。
It is not inappropriate that,when the effectiveness of the illegal construction lease contract is not clearly stipulated by laws or administrative regulations,judicial interpretation cannot cliam the invalidity of construction lease contract.The second article on the identification of the validity of the contract in the judicial interpretation of the urban building rental contract is an effective mandatory provision,but its content still needs to be improved,the domain of illegal construction shall be explicitly worked out,and the effectiveness of the legal and illegal mixture construction lease contract shall be refined.
