论医患关系中的“告知后同意法则”

Informed Consent Doctrine in the Relationship Between Doctors and Patients

随着社会经济的发展,医疗中的"告知后同意法则"日益受到世界各国立法所重视。我国因侵犯"告知后同意法则"而引起的医疗纠纷仍然存在,影响了和谐医患关系的形成。在分析"告知后同意法则"内涵的基础上,探讨其存在的法律缘由,并针对目前存在的问题提出应对措施,有助于完善我国的法律法规,构建良好的医患关系。

With the development of social economy, informed consent doctrine in the relationship between doctors and patients concerns more attention in the law. The medical disputes about Informed Consent Doctrine ex ist in our country which have influenced harmonious relationship between doctor and patients. Based on the content of Informed Consent Doctrine and analyzed the reasons of its existence, this paper gives the suggestions to solve the problem in order to perfect the law and construct the good relation between the doctors and patients.
