On the Construction of Interest Balance System in the Protection of Intellectual Property for Transgenic Plants

在知识产权的法律制度中,利益平衡机制的构建依赖立法的创制,以及相关制度的完善。对转基因植物知识产权保护还要妥善平衡其所保护并且可能为违法行为所破坏的社会公共利益。对稀缺资源进行合理分配,必须兼顾农民权的实现,才能平衡协调不同主体、不同层次、不同区域间的利益冲突,有利于对社会利益进行最佳配置,促进分配正义向矫正正义以及形式公平向实质公平的靠近,从而实现社会公平,促进基因资源因利益分享机制的构建。

Within the legal system concerning intellectual property, the construction of interests-balancing mechanism not only relies on the law creation, but also on the improvement of related system. Meanwhile, for the crop resource protection, especially for the intellectual property protection for transgenic plants, we should bear in mind the need to properly balance the public interest under its protection, which can be damaged by unlawful act. To achieve a rational allocation of the scarce resources, it＇s also essential that to realize farmers＇ rights being listed on the agenda in order to balance and coordinate the interest conflict with distinct connotations, on different levels and between different regions. Moreover, realizing farmers＇ rights is favorable for the optimum allocation of social benefit and impels distributive justice stepping from form fairness and corrective justice closer to substantial fairness, which may in term help to achieve social equity and facilitate the construction of international benefit sharing system ofgene resources.
