作为自我保护与私力救济的重要手段,私人刑事调查一直普遍存在。但在当前中国,私人刑事调查的作用往往被忽视。通过对我国私人刑事调查现状从法律制度和具体运作层面进行分析,认为目前我国相关法律建构较为简略缺失,而其实践具体运作却发展非常迅速,日后亟待完善法规以适应现实需要。

As an important method of self - protection and private help, private criminal investigation exists commonly. But nowadays in Chi- na, the、significance of private criminal investigation always doesn＇t obtain adequate attention. From the aspects of legislations and concrete opera- tions, the paper analyzes the current Chinese private criminal investigation situation, and points out that the construction of the law related to it is too simple and even nonexistent , while the concrete practical operation is developing rapidly. In order to meet the reality needs, we must amend the related legislation.
