附条件不起诉考验期内的检察监管

Procuratorial Supervision of Conditional Non-Prosecution Trial Period

新修订的《中华人民共和国刑事诉讼法》正式确立了附条件不起诉这一刑事司法制度,同时规定在附条件不起诉考验期内的监督考察主体是人民检察院。那么,检察机关究竟该如何监管,相关司法解释尚未出台,系统理论尚未形成,实践领域也仍需摸索探讨。本文主要将探索检察机关在附条件不起诉考验期内的长效监管机制,旨在充分发挥检察机关在监管和教育未成年犯罪嫌疑人工作中的具体实效作用,进一步参与到我国诉讼体制的改革中去。

The newly revised Criminal Procedure Law of the People＇s Republic of China formally established the conditional nonprosecution in the criminal justice system, at the same time main body in conditional non- prosecution trial period of su pervision and investigation is the people＇s procuratorate. So, as on how procuratorial organs supervise, the related judicial interpretation has not yet been introduced, system theory has not yet been developed, and exploration is needed in practice are as. This paper explores the procuratorial organ in the conditional non-prosecution trial period of long-term monitoring mech anism, so as to give full play to the role of procuratorial organ in the supervision and education of juvenile suspects in specific practical action, and to promote in our lawsuit system reform.
