高校教育行政行为程序问题探解

作为特殊的行政主体,高校的教育行政行为要符合正当法律程序的要求,尤其在学生违纪处分的过程中,须坚守法律保留和正当法律程序原则,最大限度的保障学生的合法权利,用合法手段维护学生权利、明确学生权力。我国高校依《普通高校学生管理规定》均制定了校纪校规,但各高校校纪校规中存在着诸如制度差异巨大,背离过罚相当原则,缺失正当法律程序等问题。在当下法治理念和权利意识不断提升的境域中,构建高校教育行政行为正当法律程序尤为重要。在理性探寻正当法律程序缺失的原因的基础上,可从规范制度建设和提供多渠道的权利救济方式等方面构建高校教育行政行为正当法律程序。

As a special administrative subject,higher education institutions should act in accordance with the legal procedures,especially in respect of disciplinary actions against students.In taking disciplinary actions,colleges must stick to the principles of law reservation and due process of law,in order to protect and defend the legal rights of the students.While the Chinese universities have all made school regulations according to College Student Management Regulations,there still exist such issues as system differences,departure from the principle of penalty corresponding with guilt,and absence of proper legal procedures.Hence,it is of utmost significance for colleges and universities to establish due legal procedures by analyzing the causes of the lack of due legal procedures,standardizing system construction and providing a multi-channel right relief system..
