健康权保障视野下的新农合制度建设研究

健康权作为公民的基本权利,有赖于国家通过积极的给付和作为促成该权利的实现。国家对公民健康权的实现义务主要包括为公民健康权的实现创设基本条件和提供物质帮助,其中建立覆盖全民范围的医疗保障制度是国家履行公民健康权保护责任的重要体现。在城乡二元社会结构背景下,我国农村居民的健康保障存在严重缺位,从而导致健康不公平之结果。新型农村合作医疗制度的建立是政府对农民健康权平等保障的重要体现。因此,应以公民健康权保障为出发点,构建新农合基本制度,包括筹资制度、基金管理制度、基金使用制度和监督管理制度。

The health right was basic right for citizens,which can be accomplished by positive payment and push of coun- try. The obligation on realization of the citizen health right for country mainly included the basic conditions should be created and material help should be provided. What＇s more, the full-covered medical insurance system embody the country guarantee the ac- complishment of health right for citizens. In the background of urban and rural different society structure, the health security of ru- ral residents was lack ,which can lead the unfair result in health. The construction of NRCMS embedyed the nation guarantee the equal health right for rural residents. Therefore, financing system, fund management system, fund using system and supervision and management system should be established based on the security of citizen health right.
