论人民法院参与社区矫正的困境与对策

Study on the Dilemmas and Countermeasures of the People's Court's Joining in the Community Corrections

人民法院参与社区矫正一方面有利于弥补社区矫正人力不足,更好地教育和改造社区服刑犯;另一方面也有利于人民法院自身审判职能和社会管理创新职能的实现,从而达到法律效果与社会效果的统一。但人民法院参与社区矫正应定位为社区矫正的决定者和矫正过程的配合者,同时要注意与其他相关职能部门的配合与协调,解决自身存在的司法资源不足的问题。

The people＇s courts take part in the community correction,which not only make up for the shortage of manpower in community corrections,inculcate and transform the prisoners in community better,but also help the court fullfill the functions of judgment and the innovation of social management.Thus,it can achieve the integration of legal effects and social effects.It is deserves attiontion that the court be the determiner of the community and the coordinator during the process of correcfion strergthen the cooperation and coordination with other concerned departments,so as to solve the problem of the shortage of the judicial resources.
