能源效率法——一个新兴法学学科的演进

Energy Efficiency Law: Evolution of a New Jurisprudential Discipline

能源革命揭示了德国能源政策及能源法的根本性变革。作为欧洲经济与政治中心,德国将成为未来"绿色经济"发展的试验田,且"绿色增长"的成功与否将取决于其国内能源的储量及使用方式。一方面,可再生能源需要被大力的推广应用;而另一方面则涉及传统能源的高效利用。与此同时,强调能源效率的能源革命也给相关法律带来了挑战。不同领域的多种规范有必要统一到一部可以普遍适用的,内容连贯,结构完善的法律中。这一问题的高度复杂性及加速发展会带来欧盟乃至世界其他国家均需要关注的一个问题,即能源效率法——一个全新法学学科的形成。本文从能源效率法的概念谈起,延伸到法学学科发展的相关标准及能源效率法的基本结构,最后探讨能源效率法若要成为一部完善的法律仍然存在的问题和发展的前景。

The energy transformation reveals a radical change of paradigms regarding the Energy Policy, as well as regarding the Energy Law in the Federal Republic of Germany. Concerning its political ideas, this country, which lies in the center of Europe, will now become the laboratory of the future for a 'green economy'. Furthermore, the'green growth'depends on the energy sufficiency, in a different manner. On one hand, renewable energies are strongly used whereas, on the other hand, energy must be economized, due to the increased implementation of efficiency. The energy transformation, which emphasizes on energy efficiency, challenges the law. In this context, the variety of regulations in different areas must be integrated into a common, coherent 'well-ordered Law'. The high complexity of the subject and the new development, arise the question regarding the formation of a new legal discipline. In this concern, not only the German development plays a part. The Legal Act of the European Union and the corresponding dispositions worldwide, have to be considered.
