中外政府信息公开诉讼制度运作规则比较研究

Comparative Study on the Operating Rules of Litigation System between Chinese and Foreign Governments' Information Disclosure

本文根据行政诉讼法学基本理论,结合当前政府信息公开诉讼所面临的现实问题,探讨先进国家政府信息公开制度,并与我国信息公开制度的立法进行比较,对政府信息公开诉讼的运作规则进行了研究,以期引起一些争鸣,达到进一步推动我国信息公开制度建设的目的。

According to the basic theories of the administrative and litigation law,combining with the existing problems faced by the government＇s information disclosure litigation,this paper compares the legislations of information disclosure between Chinese and foreign governments.It also studies the operating rules of government information disclosure so as to brings about some debates to promote the construction of government information disclosure system in China.
