摘要
就业歧视是一个全球性的社会问题。当前反就业歧视已成为我国一个十分突出的法律问题。我国没有专门的禁止就业歧视或者反就业歧视法,在相关的法律法规中存在许多不足之处,如就业歧视的界定范围过窄,就业歧视立法缺乏可操作性,就业歧视缺乏相应的法律救济途径等等。我国应当借鉴国际劳工公约和其他国家反就业的相关制度和规则,发挥政府的主导作用,加强我国的反就业歧视立法工作,以切实保障所有劳动者的就业平等权,实现公平就业。
Employment discrimination is a global social problem.Anti-discrimination in employment has become a top legal problem in China,but there is no specialized law for anti-discrimination in employment and there are many limitations in related laws and regulations.China should borrow ideas from the related laws and regulations of International Labor Conventions and other countries,play the guiding role of the government and reinforce the legislation work of anti-discrimination,so as to guarantee the equal rights for employment for all laborers.
