行政诉讼协调机制与撤诉制度是紧密联系而又不同的两种制度。《关于行政诉讼撤诉若干问题的规定》的创新与突破性规定对目前正在探索的行政诉讼协调机制提供了一定的法律依据。践行中的行政诉讼协调机制仍显先天不足和后天失调。本文旨在探讨撤诉后权利救济的方式,进一步探索目前立法框架下行政诉讼协调机制的规范。

Administrative litigation coordination mechanism and lawsuit withdrawal are closely-related and completely different systems.The innovation of The Provisions on Several Issues Concerning the Withdrawal of Administrative Litigations provides legal basis for the undergoing exploration on administrative litigation coordination mechanism.In practice, the administrative litigation coordination still seems to be congenitally deficient and acquired imbalanced.This article aims to discuss the forms of right remedy after the withdrawal of litigation, and further explore the standard of the administrative litigation coordination system in the current legislative framework.
