对我国优秀民族传统体育非物质文化遗产保护与知识产权制度兼容与互动的研究

Compatibility and Interaction on the Excellent Chinese Traditional Sports of Intangible Cultural Heritage and Intellectual Property Rights System

非物质文化遗产的知识产权保护是目前学术界关注的热点问题。民族传统体育是我国非物质文化遗产的重要组成部分,然而目前国内对民族传统体育非物质文化遗产的知识产权保护研究却是一片空白。在借鉴其他领域已有研究成果的基础上对民族传统体育非物质文化遗产等相关概念进行辨析,探讨我国民族传统体育知识产权保护的基础理论。在分析我国民族传统体育非物质文化遗产保护现状的基础上,试图从著作权保护、商标权保护和专利权保护等方面构建我国优秀民族传统体育非物质文化遗产知识产权的保护体系。

At present,intellectual property protection of intangible cultural heritage is the hot issue which academics concerns about.The Chinese traditional sports is an important composing part of intangible cultural heritage in our country,however the domestic research on the intellectual property protection of the Chinese traditional sports of intangible cultural heritage is a blank.This thesis discriminates the concept of Chinese traditional sports of intangible cultural heritage and other related concepts by drawing on the research achievements which the other field has done,discuesses the basic theories of intellectual property protection of the Chinese traditional sports.On the basis of the analysis of the status of the protection of Chinese traditional sports of intangible cultural heritage,try to establish the system of intellectual property protection of the excellent Chinese traditional sports of intangible cultural heritage from the aspects of trademark protection,copyright protection,and patent protection.
