从民事立案审查角度看如何提升司法公信力——以湖北H市中级人民法院案件数据分析为视角

How to Improve the Credibility of Justice from the Perspective of Civil Case Review:A Case Study of the Intermediate People' s Court Data Analysis in Hubei' s H City

民事立案审查工作是法院审判、执行工作的前提和基础,对提升司法公信力具有重要意义。对湖北H市中级人民法院受理民事不予受理、管辖异议上诉案件进行统计分析,发现基层法院因民事不予受理、管辖异议案件引起的立案变更率较高。民事立案审查问题,不仅影响当事人诉权实现,更直接影响司法公信力提升。从民事立案审查角度,应强化立案质量意识,重视立案队伍建设,严格立案审查标准,完善立案工作制度,加强立案调研指导,提升司法公信力。

The civil case review is the premise and foundation for the court trial and implementation and of great significance to enhance judicial credibility. Statistical analysis reveals that the change rate of registration caused by iurisdiction dispute cases is comparatively high because the Intermediate Peo- ple＇ s Court of H City, Hubei rejected civil cases. Civil case review not only affects the party＇s reali- zation of litigious right but also has impact upon the improvement of the judicial credibility. Hence from the perspective of civil case review, we should strengthen the quality awareness, attach importance to the construction of judicial personnel, upgrade the standards for case review, improve the working system and strengthen the investigation and guidance so as to enhance the credibility of justice.
