开发区管委会“身份”之困惑及社会化正解

The Identity Perplexity of Development Zone Management Committee and Its Positive Solution in Terms of Socialization

开发区立法滞后、"身份"不明。身份生成机理涉及经济全球化、试错式改革之路、政治集权与经济还权的大国治理结构、"职责同构"与"条块体制"的府际关系、国家战略定位及本身竞争力等。鉴于开发区契合于行政权社会化的治理变革、内生的契约结构、国家的战略定位、地方立法及实践的探索,法律应将试错权力配置给开发区,统一立法,将管委会身份社会化,界定为事业单位,法律、法规授权其行政主体资格,先试"多中心治理"之道。

The legislation of development zone is lagging and its lates to economic globalization, reform, the governance structure identity remains unknown. Forming mechanism re- of political centralization and economic decentrali zation, compartmentalization system of intergovernmental relations, national development zones strategic positio ning, and development zone＇ s competitiveness. In view of the identity of Management Committee （MC） that corre sponds to the socialization of administrative power of governance reform, development zone endogenous contract structure, strategic positioning, the local legislation and practice exploration, the development zone should be al- lowed for the use of trial and error to unify the legislation
