摘要
埃塞俄比亚矿产资源丰富,但勘查程度低,为了更好地了解该国矿业权制度,文章对埃塞俄比亚1994年《矿业管理条例》和2010年《促进矿产资源可持续发展公告》中与矿业权有关的条款如矿业权权属、矿业权授予部门和方式、矿业权许可证类型、与矿业权息息相关的土地准入、许可区域的重叠以及矿业权的流转等方面进行介绍,并就有关内容与我国的矿业权进行比较。中埃两国在矿业权制度上既有相同之处,又有不同之处。通过比较,更好地了解埃塞俄比亚的矿业制度,响应"走出去"政策的号召,加大对国外矿产勘查法规的了解。
Ethiopia has abundant mineral resources, but low level of prospecting and exploration. In order to further understand the mineral rights of Ethiopia, the authors first introduce the mining - related articles within Mining Regulations No. 84/1994 and Proclamation to Promote Sustainable Development of Mineral Resources No. 678/2010 of Ethiopia such as the ownership of mining rights, authorized department to grant the licenses and the way, mining right license type, and land access permission related to the mining right, permitted overlap block of the mining license and the transfer of the mining right. Based on above - mentioned, a comparison of mining rights between China and Ethiopia was summarized. There are some similarities, and also differences occur. Through the comparison, it will help us better understanding of Ethiopia mining rights, so that we can respond China＇ s ＂Go Abroad Exploration＂ policy and understand the situations of the foreign country＇ s mineral right systems and regulations.
