经济转轨时期慈善立法的必要性和可行性——促进社会分配关系良性发展,实现社会分配的实质正义

Necessity and Feasibility of Charity Legislation in the Period of Economic Transition:Promoting the Benign Development of Social Distribution Relation and Realizing the Actual Justice of Social Distribution

当前中国社会经济发生巨变,这也引起了社会分配关系的变化。贫富差距的增大迫使中国必须要调整现有的社会财富分配方式。首先论证经济转轨对分配关系的影响,经济体制与社会结构的关系决定了二者必须处在同步发展的基线上;其次论证慈善事业调整分配关系的优势和重要作用;再次,通过相关统计数据说明中国慈善行业发展的现状;最后论证慈善事业立法滞后,提出通过法律手段规范慈善事业发展的建议。

China＇s current economic and social upheaval causes the change of the society＇s distribution relation. The widening income gap forces China to adjust the current distribution of social wealth. First, this paper demonstrates the impact of economic transition on the distribution relation, and the relation of economic system and social structure deter- mines that they should be on the same level of development; second, this paper identifies the advantages and important role of charity~ adjustment of distribution relation; third, the present situation of China＇s charity industry＇sdevelopment is showed by relevant statistical data; last, delay of charity industry is proved and suggestions for regulating the charity in- dustry development by legal means are proposed.
