摘要
体育犯罪的同类法益是刑法学意义上的体育犯罪论体系建构和完善的基础。体育犯罪的同类法益是指参与或观看组织性体育比赛的真实性和纯洁性。它对于体育犯罪的刑法学概念的建构、界定体育刑事立法的处罚范围以及解释体育犯罪的违法性具有重要意义。应通过并列的多元法益论和系统的刑事立法贯彻实现体育犯罪的同类法益。
Similar legal interests is beneficial to construct and improve the foundation of sports crime system in the sense of the Criminal Law. Similar legal interests is the authenticity and purity of participating in or watching organized sports competition. It has the great significance in Construction of sports crime of criminal law concepts and define the range of sports punishment of the criminal legislation as well as explaining the illegality of sports crime. We can through diverse legal interest and the system of criminal legislation to implement the similar legal interests of sports crime.
