随着社区矫正制度由局部试点到全国推广,社区矫正工作已出现了从政策到法律的嬗变趋势;而循序渐进和稳妥严谨的立法模式是社区矫正立法更为科学、可行的选择,即从刑法、刑诉法的附属性规范以及部门规章进化到独立且系统的《社区矫正法》。基于法治精神和人权原则,刑事法律修改与未来《社区矫正法》制定的重心不能仅停留在将刑事执行权合理分配到各矫正机构,而应特别关注如何科学设置各种机制进而保障矫正机构合法履行刑事执行权,尤其是应重视社区治理,促成社区矫正从"在社区内矫正"到"依靠社区的矫正"的根本转变。
