社会自治之合法性困境——兼论政府在社会治理中的主导作用

Legal dilemma of Social Autonomy:Governments' Leading Role in Social Management

政府在社会治理格局中居于主导地位,社会在自治过程中因受权能之限制不可避免导致其在身份、权力与行为上面临合法性困境。政府有必要通过双重负责、法制导向、民事合作、选择性限制等方式引导并监督社会合法行使自治权力,并为其权力之行使与能力之增长提供所需的伸展空间。

Government plays a leading position in the social management. Social organizations cannot avoid the legal dilemma of identity, power and action in social autonomy due to the limited authority and power. Government need to direct and supervise the social autonomous power by management system of double licenses, law and order orientation, cooperation in civil matters, selectional restrictions, and offer more room for the execution of its power and the increase of its capability.
