夫妻约定财产制探究——完善《婚姻法》之设计

《婚姻法》司法解释三的出台,引发了社会关于婚姻制度的大讨论,尤其是夫妻约定财产制在中国是新兴领域,成为了民众争议的核心。本文以《婚姻法》和司法解释为基础,从夫妻约定财产制的形式要件、实质要件、告知程序、法律效力及其变更和终止等几个方面对夫妻约定财产制度加以论述,并提出相应的立法建议,以期《婚姻法》更具科学性、规范性和逻辑性,在立法和司法实践中能更加准确的理解、完善和应用。

The third judicial interpretation of the Marriage Law has evoked widespread discussions.Because the couple＇s contractual system is an emerging field,it has become the core of public controversy.On the basis of the Marriage Law and its judicial interpretation,this article puts forward corresponding legislative suggestions by discussing the couple＇s contractual property system from the aspects of its formal essentials,substantial essentials,informing procedure,legal force,modification and termination in the expectation of making the Marriage Law more scientific,normative and logical and understanding,improving and applying more exactly in the legislative and judicial practice.
