摘要
对出租车交通事故侵权责任主体进行认定时,应根据不同的运营模式,并结合"运行控制"和"运行利益"的标准来进行判断。在公司经营制模式中,出租车公司是赔偿责任主体;在挂靠经营制模式中,挂靠者是赔偿责任主体,被挂靠不承担赔偿责任;在承包经营制模式中,承包方是赔偿责任主体,发包方负连带赔偿责任;在租赁经营制模式中,出租人是否承担连带赔偿责任,以出租人对承租人的驾驶资格是否知情为前提。
The determination of tort liability subject of taxi traffic accident depends on different operational models and the standard of "op- erational control" and "operational interest". Taxi company is the subject of liabilities for compensation in company operational model. Affilia- tor is the subject of liabilities for compensation in affiliated operational model and affiliatee doesn't burden the liabilities for compensation~ con- tractor is the subject of liabilities for compensation in contracted operational model and employer has joint liabilities for compensation~ in leasing business model, the subject of liabilities for compensation of the lessor depends on whether he knows lessee's driving qualifications.
