Analysis of Rural Residential Land Use Right——from the Perspective of Property Law

现有框架下赋予的农村宅基地使用权的特性,无法充分发挥农村土地的经济价值,也有悖于传统的物权法理论。因此,应当还原其本来的面目,以充分发挥农村宅基地的经济价值和社会价值。

The characteristics of rural residential land use right granted by the existing frame fail to give full play of economic value of rural land and contradict the traditional property law. Therefore, its original function should be restored to make full use of the economic and social value of rural residential land.
