我国农村宅基地产权排他性问题探析 被引量:1

摘要 产权是关于稀缺资源利用的权利行为规则安排,它受到社会权利行为能力结构的制约。而产权制度改革关键是做好排他性权利的界限,因为它是实现制度效率的首要条件。现行农村宅基地产权呈弱排他性,即:其占有权、使用权、处分权和收益权都表现出排他性不足问题。完善农村宅基地产权制度,必须明确指导思想和改革路径,全面消除农村宅基地束性产权的非排他性,着力完善农村宅基地所有权制度,重构物权性农村宅基地产权结构。 Property is irregular arrangement concerning utilization of scarce resources ' right behavior. It is restricted by the capacity structure of the social rights. However, the core of reform the property rights system is drawing the boundaries of exclusive right, because it is the priority to achieve mechanism efficiency. The existing rural land property shows weak exclusive, that is, its right of possession, use, disposition and usufruct indicates the trouble of ex- clusiveness insufficiency. To improve property relations of the rural land, we must clear the guidelines and the reform way, we should also eliminate in all respects the non - exclusive bundle of property right of the rural land and make efforts to complete the ownership system of the rural land, reconstruct the ownership structure of the rural land.
