惩罚性赔偿在著作权侵权领域的引入

The Introduction of Punitive Damages into Our Copyright Infringement

惩罚性赔偿(punitive damages)是英美法上的一种侵权责任形式,在制裁和抑制侵权行为方面具有独特的适用效果,美国、英国和加拿大等国家已将这一侵权责任形式适用于著作权侵权领域。鉴于著作权侵权的特点和我国以盗版为代表的著作权侵权问题,本文就如何抑制我国的著作权侵权问题进行比较法研究,分析国外现有著作权法上的惩罚性赔偿制度,结合今年三月公布的《著作权法》(修改草案)中新增的惩罚性赔偿条款,对惩罚性赔偿在我国著作权侵权领域引入过程中的一些具体问题进行分析。

Punitive damages is a kind of tort liability form in common law,and has unique effect on sanctions and inhibition of tort.The United States,Britain and Canada and other countries have punitive damages for copyright infringement.In view of the characteristics of copyright infringement and piracy as the representative of the copyright infringement in China,this article carries out comparison study on how to restrain our copyright infringement problems,analyzes the existing foreign copyright laws on the punitive compensation system and summarize.Combined with the published ＂copyright law＂（draft） in the new terms of punitive damages this year in March,we discuss some specific problems in the process of taking punitive damages into our copyright infringement.
