医疗系统职务犯罪特点及防控对策——基于南京市2011年医疗系统职务犯罪实证研究

Characteristics of Duty Crimes and Its Countermeasures——Based on the Empirical Study of Duty Crimes in Nanjing City Medical System in 2011

当前,医疗系统对员工的思想教育缺乏足够的重视,存在着重业务学习,轻政治理论和法制知识学习的倾向。一些医疗机构由于内部管理不善,医疗体制不顺,监督力度不够等原因,导致医疗系统职务犯罪呈现出犯罪主体低龄化,医疗系统受贿犯罪发案率居高不下,案件后果严重、影响恶劣等特点。为遏制医疗系统职务犯罪,必须强化对医务工作者的思想教育,提高他们的职业素养;政府要继续增加投入,取消以药养医体制,完善药品采购制度;构建强有力的监督机制,把医疗系统的各项规章制度落实到实处,从根本上预防和惩治医疗系统的职务犯罪。

At present, medical system doesn＇t pay due attention to its staff＇s ideological education. Professional progress is val ued while the study of political theory and legal knowledge is neglected, which has become a tendency in medical system. What＇s worse, internal management is poor, medical institution isn＇t well organized, and the supervision power isn＇t sufficient. These factors bring about some new characteristics including the high rate of bribery crimes, serious consequences, and severe influences. To curb duty crimes in medical system, we should strengthen the ideological education of medical workers and im- prove their occupation accomplishment. Our government should continue to increase investment, cancel the system of supporting a hospital by medicine, and perfect drug procurement system. What＇s more, we should construct a powerful supervision mecha- nism, implement regulations and policies earnestly, and prevent and punish duty crimes in medical system from the source.
