我国稀土资源开发中的环境保护法律问题探讨

Disscussion on the legal problems of environmental protection in the exploiting of rare earth resources

稀土是国家重要的战略资源。我国稀土资源开发中,产生了水、大气、土壤污染以及土地植被破坏和水土流失等环境问题。从法律角度分析,国内相关立法的缺失、法律制度的内在缺陷、相关法律政策的执行与监管不力是造成这一问题的主要原因。对此,建议完善相关环境立法,建立健全环境保护基本制度,加强环境执法与监管力度。

Rare earth is a kind of important strategic resources.There are many environmental problems,such as pollution of water,air and soil,damage of land and vegetative cover,loss of water and soil erosion,during the exploiting of rare earth resources in China.Analyzing them from the angle of law,we think the main reasons of these problems include the lack of relevant domestic legislation,defect of legal system,and slackness of implementing and supervising to laws and policies concerned.Therefore,we suggest that we should improve environmental legislation concerned,establish and perfect environmental law systems and strengthen the implementing and supervising of environmental laws.
