Witness System in the context of the new "Code of Criminal Procedure"——causes,countermeasures and legislative proposals to witnesses refused to testify

当前司法实践中,常遇到证人出庭少、作证难甚至拒绝作证的问题。本文依据新修订的《刑事诉讼法》,结合司法实践,研究证人作证制度,分析证人拒绝作证的成因,并提出相应对策和立法建议。

In the current judicial practice,there are often problems of less attendance of witnesses,difficult to testify and even refused to testify.The author,based on the newly revised ＂Code of Criminal Procedure＂ and the judicial practice,researched the witness system,analyzed the causes of the witness refused to testify,and proposed the corresponding countermeasures and legislative proposals.
