职务犯罪案件起诉工作是检察机关履行法律监督职责的重要工作内容之一。职务犯罪的侦查与不起诉工作具有其特殊性,群众关注度高,社会影响巨大,这类案件定罪起诉的难度大大高于普通刑事案件,它的运行状况也事关检察机关形象,关乎中央的反腐大局,而且就正常的侦查规律来讲,不可能所有的职务犯罪立案侦查后,检察机关均以起诉结案。因此,对于职务犯罪的不起诉工作运行情况进行分析,就显得十分必要。本文从职务犯罪不起诉决定程序控制运行现状,职务犯罪不起诉监督机制存在的问题等方面进行了论述,并对职务犯罪不起诉监督机制提出了改进建议。

The prosecution of job-related crime is one of the important work of procuratorial organs to fulfill their legal oversight responsibilities.Investigation and nol pros of job-related crime has its own peculiarity,with high interest of the masses and huge social impact.The conviction and prosecution of such cases are much more difficult than the ordinary criminal cases,whose operations are related to the image of procuratorial organs and the overall situation of the central combating.In terms of the normal law of the investigation,it is not possible that all the job-related crimes are closed by the prosecution by the procuratorial organs after the investigation.Therefore,it is very necessary to analyze the situation of nol pros of job-related crimes.The paper discussed the situation and problems of the oversight mechanism of nol pros of job-related crime and put forward suggestions for improvement.
