对竞业禁止制度的思考

On Prohibition of Business Strife

竞业禁止制度是一种防止企业内部成员给企业造成不良竞争状态,保护企业利益的制度。然而,我国当前无论立法还是司法都没有对竞业禁止制度给予应有的重视,仍存在不足,需要尽快加以完善。一是完善我国现行立法;二是加强司法审判工作;三是增强企业和利害关系人的自我保护意识和保护措施。

Prohibition of business strife prevents mal-competition from members of enterprises and protects ben- efits of the enterprises. At present in China, however, both legislation and justice fail to pay enough attention to prohibition of business strife and deficiencies demand perfection. Measures are listed as follows： perfecting Chi- na＇s current legislation; strengthening judicial judgment; enhancing self-protect consciousness and measures of the entervrises and relevant inclivichml~
