专利侵权损害赔偿额的影响因素研究——基于我国24个地区专利侵权案件的实证

On the Influencing Factors of the Amount of Patent Infringement Damages: An Empirical Study Based on the Court Cases in 24 Regions

以中国24个省、自治区、直辖市的43家法院判决的专利侵权案件为样本,对我国专利侵权损害赔偿额的影响因素进行了实证研究。结果表明:专利类型、专利侵权行为数量、请求赔偿额、东部地区变量对赔偿额有显著的正向影响;侵权时间、侵权人数、年份变量对赔偿额没有影响,最后,针对专利权人举证、相关制度的完善提出了建议。

Based on the sample of the patent infringement cases judged by 43 courts in 24 provinces, municipalities, and autonomous re- gions, an empirical study is conducted to explore the impact factors of the amount of patent infringement damages in China. The results show that： the type of patent, the numbers of ways of infringement, the amount of claimed damages, and eastern region variables have a positive significant effect on the amount of damages judged, while the time duration of infringement, the number of infringer and the year variables have not. Finally, some recommendations on the patentee＇s proof and the improvement of relevant systems are presented.
