论取水权转让制度的正当性

On legitimacy of transfer system of water right

取水权转让制度的正当性研究是制度立法的前提,也为制度的有效实施提供可能。结合水权概念、制度正当性理论以及人类中心主义理论,提出取水权转让制度的理论基础:体现技术理性与价值理性相统一的反思的人类中心主义;根据有限理性理论,通过对取水权转让制度的正当性的内容,即取水权初始分配的人性化与公平、取水权转让的社会功利与效率两个方面的分析,探讨了对二级市场的取水权转让进行适当限制的原则和具体途径。

Studies on the legitimacy of transfer system of water right are the prerequisite to the system legislation and may also provide possibility for the effective implementation of the system.Combined with the conception of water right,the theory of system legitimacy and the anthropocentrism,the theoretical basis for the transfer system of water right is put forward,that is,the reflective anthropocentrism which exhibits the unity of technical rationality and value rationality.Based on the theory of limited rationality,through the analysis of the content of legitimacy of transfer system of water right,which includes the humanization and fairness of the initial allocation of water right and the social utility and efficiency of water right transfer,the principles and specific ways to properly restrict the transfer of water right in the secondary market are studied.
