摘要
2011年公布的民事诉讼法修改草案中,增加了一条有关公益诉讼的内容,这是我国民事诉讼立法上的一大突破,引起了广泛而热烈的讨论。本文通过联系我国现实的法制状况,对提起公益诉讼的不同主体的资格进行探讨,提出一些建议。
In the Amendment to the Civil Procedural Law published in 2011,a provision concerning to public interests litigation was presented for the first time.It was a breakthrough in the legislation progress and aroused extensive and heated discussion.This article attempts to discuss the qualification of different subjects who issue public interests litigation,making reference to China＇s legal circumstances,and tries to offer some advices.
