校规与学生权利之研究

针对近年来校规与学生权利频频发生的冲突,从教育法学的视角,首先探讨校规的地位及其合法性,然后针对学生享有的基本权利进行讨论,从而引出学校规章制度与学生权利的矛盾和问题,最后提出对校规和学生权利的展望,从学生本位出发促进校规的健全发展,优化校规的制度改革。

In recent years,the conflict has often happened between the school rules and students＇ rights.The writer wants to make an analysis from the perspective of the Education Law.First of all the writer will investigate the status and legitimacy of the rules and regulations,and then discusses the fundamental rights enjoyed by the students,which leads to contradictions and problems of school regulations and the rights of students.Finally,the writer will make the outlook of the school rules and the rights of students,which starting from the students based to promote the sound development of the rules and regulations,optimizing the reform of the rules and regulations.
