困境与出路:诊所法律教育的本土化命题——基于广东法学专业的考察

The Dilemma and Solutions of Clinical Legal Education in China: Based on the Investigation of Law Specialty of Guangdong Universities

诊所法律教育的引进有助于克服法学教育小成本、低门槛运作的弊端及提高法科学生的实践能力。广东各校法学专业的实践表明,新建的法律诊所在发展中面临着教学理念、教学资源和实际操作等方面的短板,无法给概念法学教学模式带来根本性变革。完全普及美式诊所法律教育不切实际也无此必要,走出法学教育本土化困境的出路在于积极进行相关具体制度的培育。

The adoption of clinical legal education （CLE） been hailed as a possible solution to the various problems faced boosts the practice ability of law students. And it has with China＇s law schools. The practice shows that the totally-popularized American CLE is neither practical nor necessary. The experience of Guangdong, however, points to another direction which calls for more adaptations to it and the cultivation of supporting mstitutions.
