摘要
《中华人民共和国人民调解法》通过把人民调解与司法、行政进行衔接,使人民调解具有了终结纠纷和获得政府财政支持的可能。由于这种制度创新处于初创阶段,它存在人民法院的业务指导功能没得到有效发挥,政府财政对人民调解的支持力度不足两个突出问题。在今后的法律实施中,我国应尽快出台与《人民调解法》的创新制度有关的配套措施。
The judicature and the administration are integrated with the People′s Mediation in the Law of People′s Mediation,which gives the People′s Mediation the functions of ending the disputes and acquiring the governmental funds.However,the innovation on the law of People′s Mediation is on primary stage,there are two obvious problems in People′s Mediation System.One is that the court has few directive function on business,the other is which the financial supports from the government is not enough.In order to solve the two problems,supporting measures should be laid down.
