“大调解”之制度创新及其存在问题

System Innovation and Existing Problems in Comprehensive Mediation of Social Contradictions

"大调解"是近年来我国实施的一种多元化社会矛盾调处机制。该机制在制度设计上突出党委、政府的主导地位,强调调解主体的联动性,将人民调解、行政调解和司法调解等调解资源整合在一起,构建"三位一体"的工作体系,在社会治安综合治理及社会矛盾调处方面发挥了重要作用。但由于"大调解"尚处于探索阶段,因而在实践中暴露出诸多问题。站在构建社会主义和谐社会的高度,我们应认真研究"大调解"机制,分析"大调解"在制度上的创新及其存在的问题,以此为基础构建具有中国特色的多元化社会矛盾调处机制。

＂Comprehensive Mediation＂ is a multivariate mediation mechanism of social contradiction that our country has been executing in recent years.This mechanism highlights the dominant position of Party committee,government,emphasizes the linkage of mediation body,puts people＇s mediation,administrative mediation,judicial mediation together,constructs the trinity system of work,plays an important role in the comprehensive management of social security and social contradictions mediation.Because ＂Comprehensive Mediation＂ is still in the stage of exploration,it exposes many problems in practice.In order to construct the socialist harmonious society,we should study ＂Comprehensive Mediation＂ mechanism seriously,analyze its institutional innovation and existing problems,construct a multivariate mediation mechanism of social contradiction with Chinese characteristics on this basis.
