摘要
文章通过分析国际层面、区域层面和国别层面对于直接性别歧视、间接性别歧视、多重性歧视和制度性性别歧视的适用,指出关注点已从辨识与纠正孤立的针对个人的直接/间接性别歧视转变为通过暂行特别措施致力于纠正和消除制度性性别歧视。与此同时,在探讨确立法律的社会性别分析框架时,借鉴并吸纳了女权主义法学解读法律的洞识,即法律有着不同但相互影响、相互作用的维度,力图使框架能够反映制定法、司法/法律的执行以及传统习俗和文化的互动,以更有效地剖析这样的法律文化和法律制度在保障两性平等方面的盲点和不足。
On the basis of an analysis of direct, indirect, multiple and structural or systemic gender discrimination applied at international, regional and national levels, this article notes that attention has been shifted from identifying and denouncing individual-oriented direct and indirect gender discrimination to punishing and eliminating systemic gender discrimination by means of temporary special measures. While mapping out a gender analysis framework to be used in the legal field, this article expects that the framework will also reflect the interaction among three aspects of the law, namely, statute law, judicial practice and law enforcement, and tradition and culture, the findings and insights contributed by feminist jurisprudence; and hopes that more efforts can be made to the effective study of blindness and insufficiency of protection of gender equality in legal culture and system.
