论共同居住人的继续承租权

我国《合同法》第234条确定了共同居住人的继续承租权制度,然而对于共同居住人的继续承租权的性质、享受继续承租权的共同居住人的主体范围、继续承租权适用的具体对象,共同居住人行使该项权利的先后顺序等等都缺乏明确具体的规定。我国立法应该在借鉴外国先进立法的基础上加以完善,进一步明确共同居住人的主体范围,规定该权利行使的具体条件,以便更好的适用。

Our country ＂contract law＂ 234Th article identifying the common people living continue to lease system, however, there are not specific and clear provisions about the nature of the common people living continue to lease, the specific main scope and the subject of the right to continue to lease, and priorities to use lease.In order to better apply ,the legislation of our country should draw lessons from foreign advanced legislation on the basis of perfect, further defined the main body about the common people living continue to lease , and the specific conditions to exercise this rights.
