《最高人民法院关于适用〈中华人民共和国婚姻法〉若干问题的解释》对婚后父母为子女出资买房归属、一方婚前按揭买房归属和夫妻购买父母房改房的归属作了详细的规定。对司法实践中的法律适用起到了指导作用,为不同地方法院作相同判决奠定了基础,一定程度上维护了司法的统一性。但是这些内容是按照一般财产法的原理进行设计的,其与婚姻法和此前的司法解释相矛盾。
