摘要
美容整形包括生活美容和医学美容两种。由于医学美容具有不同于传统医学只为"治病救人"的特殊性,再加之现今该行业出现的混乱局面,给伦理机制和法律制度(特别是刑事法律制度)带来了严峻的挑战。目前,美容整形本身易诱发较大的风险,并且不规范的美容整形市场为犯罪的滋生提供了合适的土壤;医学美容整形的犯罪存在多种表现形式;对美容整形的犯罪问题进行刑事干预,基本途径主要是加强刑法解释工作和适度增补新的犯罪类别。
Cosmetic plastic surgery includes life cosmetology and medical cosmetology. Because of its particularity which is different from the traditional medicine with the purpose of ＂curing the sickness＂, and the confusion arising in this field, medical cosmetology has brought serious challenges to the ethical mechanism and legal system （including criminal law system）. Currently, cosmetic plastic surgery is easy to induce great risks, and the non-standard cosmetic markets provide suitable soil for the growth of crime. There exist a variety of crime forms in cosmetic plastic surgery. And the basic ways to intervene the crimes in cosmetic plastic surgery are to strengthen the explanation of criminal law and supplement new crime categories moderately.
