简论生命法与卫生法的关系

Brief Discussions on Life Laws and Health Laws

生命法从卫生法中分化而出,与高新生命科技关系密切或与生命伦理关系复杂,为传统卫生法框架难以容纳。生命法由于涉及少数人的生命现象(如同性恋及其婚姻合法化)、涉及动物福利和生态保护,也很难归入科技法的范畴。生命法与卫生法、科技法是从不同角度对法的归类,它们有部分交叉势所难免,但其核心部分无法相互替代。生命法学是一门具有时代特色的新兴法学前沿学科,其学科基础相对薄弱,但前景广阔。

Life laws, which are closely related to advanced and latest life science and technology or have a complex relationship with life ethics, differentiate from health laws, and it is difficult for them to be categorized by the traditional health law framework. Because life laws involve a few people＇s life phenomenon （ e.g： gays and the legalization of their marriages）, animal welfare and ecological protection, it is also difficult for them to be catego- rized by science and technology laws. Life laws, health laws and science and technology laws are categorized from different aspects, and it is unavoidable for them to be overlapped partially, but the core part cannot be replaced by each other. Life Jurisprudence is a newly developing frontier subject with characteristics of the times. While the base of the discipline is relatively weak, its future is promising.
