近年来,在法官决策和公众评判之间,存在着相当大的分歧。但在法理基础、直觉认识和经验判断上,法官决策与公众评判又是存在交集的。本文基于司法裁判的微观分析,认为在一个具体的待决疑难案件中,法官可以通过努力,最终弥合自身决策与公众评判的分歧。通过坚持司法理性,经过无数个案的累积,可以培育应有的司法公信。

In recent years, considerable differences exist between the iudge decision and puollc evaluation. But there are intersections between them when it comes to legal theories, intuitive understanding and experiences. Based on the micro-analysis of judicial adjudication, the judge, through his meticulous work in a tough case can make up the difference. And with iudicial rationality and the accumulation of experience from numerous cases, the right public judicial credibility is cultivated.
