著作权语境中的收回权分析

On the Right of Retraction in the Context of Copyright

作为一种特殊的著作人身权,收回权体现了对著作权的一种较高的保护水平。法律规定收回权不仅体现全社会对作者处分其作品的尊重,也体现在人身权利和财产权利发生冲突时立法者的价值选择。文章对收回权作为一种第一性的权利,其行使应当无任何前置条件,收回权具有特殊的法律特征、收回权的损失补偿进行了探究。

As a special moral right of authors,the right of retraction reflects a higher level of the protection of copyright.The law provides that the right of retraction embodies not only the respect of the society for the authors＇ disposal right of their works,but also the value selection of law makers between personal right and property right.This paper argues that as a general legal right,the right of retraction should be exercised without any preconditions attached.The special legal characteristics of the right of retraction and the compensation for loss are also analyzed in the paper.
