遗失物拾得制度的反思及完善

我国法律对于遗失物拾得制度的规定,还是比较全面的。但是,过多地强调了遗失物拾得人的义务,而忽视了其该享有的权利,表现出有失公平的现象。法律规定应当在遗失物权利人和拾得人的权利与义务之间寻找一个平衡点,通过增加遗失物拾得人的报酬请求权和在一定条件下的所有权,来平衡拾得人的权利和义务。

In general, our current lost property picked up system is perfect, but it also has many deficien- cies. It too much emphasis on the obligations of finders while ignored the rights they should have. It＇s unfair. Laws should maintains the balance between losers and finders＇ rights and obligations, increases the finders＇ re- ward claim and property in some condition, and it will balance the rights and obligations of finders.
