论“司法强拆”的合法性基础

On the Legitimacy of Judicial Demolitions

"司法强拆"作为行政强制执行方式之一,产生对公民财产权的限制作用。其合法性基础在于:应以法律形式规定法院的司法性执行权,而非行政法规,以符合形式法治的要求;其取得,不能只有《行政诉讼法》和《行政强制法》的一般性规定,而应有财产权限制的专门立法的具体和明确的授权,以符合法律保留原则和实质法治的精神。虽然2011年《国有土地上房屋征收与补偿条例》中有关"司法强拆"的规定的合法性尚可将就,但立法机关应主动进行征收立法,否则"司法强拆"的合法性基础仍然欠缺。

As one of the administrative enforcement modes, judicial compulsory demolition produces the effect of restriction to citizen＇s property right. Its legitimacy foundation includes ： in order to meet the requirements of the form of the rule of law ,judicial execution power should be provided by the form of law, instead of administrative regula- tions;we should formulate not only ＂ administrative procedure law＂ and＂ administrative enforcement law ＂,but also authorize the property right restriction legislation, to comply with the principle of legal reservation and the essence of the spirit of the rule of law. Although the legitimacy of ＂ judicial compulsory demolitions＂ in the ＂2011 Housing on the State- owned land levy and Compensation Ordinance＂ should be strengthned, but the legislature shall also actively carry out the legislation of levy , or＂ judicial compulsory demolitions＂ will lack legitimacy foundation.
